Terms of service
1. Identity of the seller
This site is operated by DAJE, an entrepreneur individuel registered in France, trading as YONAKU. Registered office: 7 rue du Tangor, 11100 Narbonne, France. Email: contact@yonaku.com — Telephone (SMS only): +1 332-249-4051.
The full identification details of the operator — company number, trade register entry and VAT number — are set out in our Legal Notice.
These Terms of Service govern all orders placed on yonaku.com. By placing an order you accept them in full. They are made available before the order is confirmed and you are asked to accept them at checkout.
2. The products
We sell Japanese-inspired clothing, footwear, accessories and home objects. Unless a product page states otherwise, our pieces are made to Japanese designs but not manufactured in Japan. We state this expressly so that no buyer is misled as to origin.
The essential characteristics of each item — material, construction, measurements — are set out on its product page. Photographs are indicative; colours may vary with screen calibration. Sizes follow Asian sizing and run approximately one size smaller than US sizing; the measurements given are the reference.
3. Orders
The order process is: selection of items, review of the basket, entry of delivery and billing details, choice of payment method, review of the complete order, and confirmation. You can identify and correct errors at each step before confirming.
The contract is formed when we send you an order confirmation by email. We archive order confirmations and make them available on request.
4. Prices and payment
Prices are displayed in the currency selected on the site, inclusive of all taxes applicable to your delivery destination, and include customs duties and import taxes where we prepay them. Shipping is free.
Payment is taken in full at the time of order through the payment methods shown at checkout. Payment data is processed by our payment providers over an encrypted connection; we do not store card numbers.
Prices may change at any time, but the price applicable to your order is the one displayed when you confirm it.
5. Availability
If an item becomes unavailable after your order, we inform you and refund that item in full within 14 days. We may decline or cancel an order where we reasonably suspect fraud, where the delivery address cannot be served, or where a price has been displayed in manifest error.
6. Delivery
Delivery terms, times and transfer of risk are set out in our Shipping Policy, which forms an integral part of these terms.
7. Right of withdrawal and returns
Your statutory right of withdrawal, our 30-day commercial return policy, the model withdrawal form and the applicable exclusions are set out in our Refund Policy, which forms an integral part of these terms.
8. Legal guarantees
All goods benefit from the statutory guarantee of conformity (articles L.217-3 to L.217-17 of the Code de la consommation) and from the guarantee against latent defects (articles 1641 to 1649 of the Code civil). Full details, including time limits and remedies, are set out in our Refund Policy. No clause of these terms limits or excludes these guarantees.
9. Intellectual property
All content on this site — texts, product descriptions, photographs, illustrations, layout, and the YONAKU name and marks — is our property or used under licence and is protected by intellectual property law. Reproduction, representation, adaptation or exploitation, in whole or in part, is prohibited without our prior written consent.
10. Acceptable use
You agree not to use the site for any unlawful purpose, not to attempt unauthorised access to any part of it, and not to introduce malicious code. We may suspend access where these terms are breached.
11. Personal data
The processing of personal data is described in our Privacy Policy. You may exercise your rights of access, rectification, erasure, restriction, portability and objection by writing to contact@yonaku.com, and lodge a complaint with the CNIL.
12. Liability
We are liable for foreseeable loss resulting from a failure to perform these terms. We are not liable for unforeseeable loss or for business losses. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded by law — in particular liability under the legal guarantees set out above.
13. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including carrier disruption, customs action, natural events, industrial action or failure of public networks.
14. Complaints and mediation
Complaints should first be addressed to contact@yonaku.com. We acknowledge within one business day and answer substantively within 14 days.
Consumers resident in the European Union may refer a dispute to the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr. Customers elsewhere should write to us directly; every complaint receives a substantive answer.
15. Changes
We may amend these terms. The version applicable to your order is the one published on this page at the moment the order is confirmed.
16. Governing law and jurisdiction
These terms are governed by French law. If you are a consumer resident in another country of the European Union, you also retain the mandatory protections of the law of your country of residence. Disputes fall within the jurisdiction of the courts designated by the applicable rules of civil procedure; a consumer may always bring proceedings before the courts of their place of residence.
